Conditions of use for the website freizeitraum.ch, operated by Vangarder GmbH.

Please note: the legally binding version of these terms is the German one. This English text is provided for convenience only. In the event of any discrepancy, the German version prevails.

Conditions of use

By accessing the website of Freizeitraum.ch you confirm that you have understood and accept the following conditions of use. If you do not agree with them, please refrain from using the site. The website www.freizeitraum.ch (the “web portal”) belongs to Vangarder GmbH, which claims all rights to it. The web portal is an online course portal on which companies and private individuals can publish or search for courses.

Ownership

All elements of this web portal belong exclusively and entirely to Vangarder GmbH, in particular word marks, figurative marks, acoustic marks and logos, unless stated otherwise. Without prior written consent from Vangarder GmbH, neither the web portal nor parts of it may be copied, modified or used on other web portals, whether in whole or in part. Content may not be copied from the portal or framed within third-party websites. Even where consent has been given, the content may not be altered in any way and all copyright and other intellectual property laws must be observed.

Exclusion of liability

Vangarder GmbH accepts no liability for damage or consequential damage arising from access to the web portal or parts of it, or from the use of the information or offers it contains. No warranty is given that the web portal will operate without errors or be continuously available, or that errors will be corrected.

The web portal, including all content it contains, is provided as is. We hereby exclude all representations and warranties. Although Vangarder GmbH takes care to ensure that the information on the portal is accurate at the time of publication, no warranty can be given regarding that information, including towards third parties. All information may be changed or deleted at any time without notice. Use of the information is at your own discretion and risk.

To the extent permitted by law, Vangarder GmbH excludes all liability for damages arising from or in connection with the use of the web portal. This exclusion also applies to its board members, officers, agents, contractors, shareholders and employees.

Rights and obligations

We work continuously to improve the web portal and adapt it to needs and requirements. We reserve the right, however, to change or discontinue features of the portal at any time and without prior notice.

We are not responsible for the online or offline conduct of users and accept no responsibility or liability for their behaviour or for the information they provide.

We are entitled, but not obliged, to review or monitor information posted by users. In any case we reserve the right, at our own discretion, to investigate the use of our web portal and to take appropriate measures against anyone who violates our conditions or applicable Swiss law. In such cases we reserve the right to remove that user's information from the portal immediately and to block the user from future use.

User liability

As a user you bear sole responsibility for your use of the web portal and for all related actions, including your dealings with other users. You undertake to indemnify Vangarder GmbH and its affiliated companies, as well as their respective board members, officers, agents, contractors, shareholders and employees, against all claims, costs and expenses, including reasonable legal costs, arising in connection with your use of the portal or your conduct towards other users.

Complete and current information

Users undertake to keep all information about themselves current, accurate and complete, and to update without delay any information relevant to the use of the portal. It is not permitted to give false information about your age or your identity.

User content

We allow users to upload information to the portal in the form of course listings, which are then made available to other users. Each user is responsible and liable for uploading and transmitting their own information. As a user you warrant that you do not breach applicable Swiss law, that you do not infringe the rights of third parties and that your listings contain no unlawful material. In particular you undertake not to use the portal to collect email addresses or telephone numbers. It is not permitted to impersonate another natural or legal person, or to enter courses on behalf of another person without a mandate or employment relationship.

Paid services

Vangarder GmbH offers paid services on the web portal. The fee for paid services, the payment terms and the scope and duration of the service are set out on the portal. The details published on the portal at the time the contract is concluded or renewed are the relevant ones and form part of the contract between Vangarder GmbH and the user.

The validity of paid services acquired in connection with a particular use expires if that user content is deleted. Refunds of fees are excluded in all cases.

Termination and changes to services

The contractual relationship between Vangarder GmbH and the user may be terminated by either party at any time with immediate effect. Fees for services already paid for will not be refunded under any circumstances. We reserve the right to suspend, discontinue or replace our services in whole or in part. We further reserve the right to make free services chargeable in future and to change paid services or their fees at any time.

Vangarder GmbH has no influence over how the providers of linked websites handle the information or offers shown there, and is not responsible for their content, their services or their compliance with data protection rules. The respective terms of use of those providers, together with any provisions on service fees and disputes, should be observed. Vangarder GmbH has no control over information stored on external servers, public servers, Usenet news servers, discussion forums, chat rooms and the like. Following a link is at your own risk.

When collecting, storing and using personal data we comply with the applicable data protection regulations.

Place of jurisdiction and applicable law

Swiss substantive law applies to any disputes. The competent court is that of Cham, the registered office of Vangarder GmbH.
